Death Toll Rises After Tornadoes Slam Central Oklahoma

DEVELOPING: Deadly tornadoes touched down Friday west of Oklahoma City, crumbling cars and tractor-trailers, trapping motorists and killing at least two.

The Oklahoma Highway Patrol said troopers found the bodies of a mother and a child near a vehicle along Interstate 40 west of the city. The state medical examiner's office said at least 3 others were killed in Oklahoma City suburbs Friday.

Hospitals in the area say dozens of people were hurt, five critically, but meteorologists who had warned about particularly nasty weather said the storm's fury didn't match that of a deadly twister that struck suburban Moore last week.

The broad storm in Oklahoma hit during the evening rush hour and stuck around, causing havoc on Interstate 40, a major artery connecting suburbs east and west of the city, and dropping so much rain on the area that streets were flooded to a depth of 4 feet.

To the south, a severe storm with winds approaching 80 mph rolled into Moore, where a top-of-the-scale EF5 tornado killed 24 on May 20.

Rick Smith, the warning coordination meteorologist for the National Weather Service at Norman, said that while the storm packed a powerful punch, it wasn't as strong as the Moore tornado.

"This storm had everything you could handle at one time: tornadoes, hail, lightning, heavy rain, people clogging the highways," Smith said.

The region was fortunate because the storm touched down mostly in rural areas and missed central Oklahoma City.

"It's not even close to anything like what we had last week," Smith said. "We were very concerned this would move into downtown. It would have been a major problem. It made all the difference that it was out in the country."

The U.S. averages more than 1,200 tornadoes a year and most are relatively small. Of the 60 EF5 tornadoes to hit since 1950, Oklahoma and Alabama have been hit the most -- seven times each.

Heavy rain and hail hampered rescue efforts in Oklahoma City. Frequent lightning roiled the skies well after the main threat had moved east. Highways and streets were clogged late into the night as motorists worked their way around flooded portions of the city. Will Rogers World Airport said flights wouldn't resume until morning, after debris was cleared from runways.

Oklahoma Highway Patrol Trooper Betsy Randolph said troopers found the bodies of a woman and an infant near their vehicle. Randolph said it's not known if the woman was driving into the storm when it hit around 7 p.m. Friday.

Emergency officials reported that numerous injuries occurred in the area along I-40, and Randolph said there were toppled and wrecked cars littering the area. Troopers requested a number of ambulances at I-40 near Yukon, west of Oklahoma City.

Standing water was several feet deep, and in some places it looked more like a hurricane had passed through than a tornado. More than 86,000 utility customers were without power.

In Missouri, the combination of high water and fallen power lines closed dozen of roads, snarling traffic on highways and side streets in the St. Louis area. At the Hollywood Casino in suburban of Maryland Heights, gamblers rushed from the floor as a storm blew out windows and tore off part of the roof.

Rich Gordon, of Jefferson City, said he was on the casino floor when he heard a loud "boom."

"I didn't know if it was lightning or what, but it was loud," Gordon said.

In Oklahoma, storm chasers with cameras in their cars transmitted video showing a number of funnels dropping from the supercell thunderstorm as it passed south of El Reno and into Oklahoma City just south of downtown. Police urged motorists to leave I-40 and seek a safe place.

"I'm in a car running from the tornado," said Amy Sharp, who last week pulled her fourth-grade daughter from the Plaza Towers Elementary School as a storm approached with 210 mph winds. "I'm in Norman and it just hit Yukon where I was staying" since last week's storm.

"I'm with my children who wanted their mother out of that town," Sharp said, her voice quivering with emotion.

At Will Rogers, passengers were directed into underground tunnels as the storm passed just north of the airfield. However, people near the area said they weren't aware of any damage.

Television cameras showed debris falling from the sky west of Oklahoma City and power transformers being knocked out by high winds across a wider area.

As the storm bore down on suburban Oklahoma City, Adrian Lillard, 28, of The Village, went to the basement of her mother's office building with a friend, her nieces, nephews and two dogs.

"My brother's house was in Moore, so it makes you take more immediate action," Lillard said while her young nieces played on a blanket on the floor of the parking garage. "We brought toys and snacks to try our best to keep them comfortable."

Well before Oklahoma's first thunderstorms fired up at late afternoon, the Storm Prediction Center in Norman was already forecasting a violent evening. From the Texas border to near Joplin, Mo., residents were told to keep an eye to the sky and an ear out for sirens.

Friday evening's weather came after flash flooding and tornadoes killed three people in Arkansas late Thursday and early Friday. Three others were missing in floods that followed 6 inches of rain in the rugged Ouachita Mountains near Y City, 125 miles west of Little Rock.

This spring's tornado season got a late start, with unusually cool weather keeping funnel clouds at bay until mid-May. The season usually starts in March and then ramps up for the next couple of months.

Grisly new photos have emerged of the bloody crime scene where South African paralympian Oscar Pistorius shot his girlfriend, model Reeva Steenkamp last Valentine's Day.

Sky News has obtained the exclusive pictures from inside Pistorius' house in Pretoria, where the crime occurred.

The most disturbing image show pools of blood on the floor of the bathroom, a panel missing from the door, and two police markers under the door handle, pointing out bullet holes. The bullet holes are low on the door, which may back up the runner's claims that he was on his stumps when he shot at someone he believed was an intruder.

The runner says that after a quiet evening with Steenkamp, he got up in the middle of the night to bring a fan in from the balcony and heard a noise. He says he grabbed a gun he kept for security purposes and ran down the hallway to the bathroom, without his prosthetic legs on.

He told a judge at his February bail hearing that he then fired four shots into the closed bathroom door. Pistorius says it wasn't until he returned to his bedroom and saw that Steemkamp was not in bed that he realized he had shot her in the bathroom.  

Pistorius insists he was in love with Steenkamp and the shooting was an accident.

During his court appearance the athlete said once he realized his fatal mistake, he did everything possible to save his lover, including beating the bathroom door with a cricket bat to get to her.

The graphic photos show a trail of blood from the bathroom as Pistorius carried Steenkamp downstairs and shouted for help. There are also pictures of flecks of blood on the wall, the landing and the sofa downstairs.

Another photo shows a container of heart-shaped sweets and a Valentine's Day gift the model had wrapped for Pistorius, with a card saying "Ozzy," her nickname for him.

The prosecution maintains that Steenkamp ran into the bathroom after the two had a fight and he deliberately shot her. Authorities say Pistorius took the time to put on his prosthetic limbs before he shot her, which indicates the murder was premeditated.

The pictures were released after allegations that cops involved in the investigation have been questioned following the disappearance of one of Pistorius' watches from his home. Sky reports there are more allegations that investigators may have tainted evidence.

When contacted by Sky, the South African Police Service had no comment.

Pistorius – who is out on bail-- is scheduled to be in court next Tuesday.

COLUMBUS, Ohio –  Verbal gaffes by Ohio State University president Gordon Gee have long been a source of amusement and headaches at the school, whether he was calling the state governor a "dummy" two decades ago or more recently likening the challenges of holding together university divisions to "the Polish Army."

His bosses, the university trustees who hired him for two separate stints as president, gave him plenty of leeway in the past. That hands-off approach makes their strong reaction to his latest comments all the more remarkable.

Gee, one of the most well-known college presidents in the country, is having to undergo a "remediation plan" after making remarks about "damn Catholics" and attacking the academic integrity of the Southeastern Conference.

"Offensive statements," Ohio State board chairman Robert Schottenstein called the remarks.

"For the leader of a renowned university, inappropriate comments about particular groups, classes of people or individuals are wholly unacceptable and are not in line with what we aspire to be as an institution of higher education," Schottenstein said in a statement.

Gee said Notre Dame was never invited to join the Big Ten conference because the university's priests are not good partners, joking that "those damn Catholics" can't be trusted, according to a recording of a meeting he attended late last year.

Gee also took shots at schools in the Southeastern Conference and the University of Louisville, according to the recording of the December meeting of the school's Athletic Council that The Associated Press obtained under a public records request.

The remediation plan will "address his behavior that reflects the Board's commitment to returning to the core messaging of the university and its leadership," Schottenstein said.

Ohio State trustees learned of Gee's "offensive statements" in January, met with the president at length and created the remediation plan, Schottenstein said.

Gee was on a long-planned family vacation and unavailable for comment, Ohio State spokeswoman Gayle Saunders said. He apologized in a statement released to the AP.

"The comments I made were just plain wrong, and in no way do they reflect what the university stands for," he said in the statement. "They were a poor attempt at humor and entirely inappropriate. There is no excuse for this and I am deeply sorry."

Gee told members of the council that he negotiated with Notre Dame officials over joining the Big Ten during his first term at Ohio State, which began more than two decades ago.

"The fathers are holy on Sunday, and they're holy hell on the rest of the week," Gee said to laughter at the Dec. 5 meeting attended by Athletic Director Gene Smith, several other athletic department members, professors and students.

"You just can't trust those damn Catholics on a Thursday or a Friday, and so, literally, I can say that," saidGee, a Mormon.

In the recording, Gee referred specifically to dealing with the Rev. Ned Joyce, Notre Dame's longtime executive vice president, who died in 2004.

"Father Joyce was one of those people who ran the university for many, many years," Gee said.

Gee said the Atlantic Coast Conference, which added Notre Dame in all sports except football and hockey, did so at a time when it was feeling vulnerable.

"Notre Dame wanted to have its cake and eat it, too," Gee said, according to the recording and a copy of the meeting's minutes.

"Regrettable" and "inappropriate" summed up the reactions from universities mentioned by Gee at the meeting, including Notre Dame, Louisville, Kentucky and schools in the Southeastern Conference.

Ohio State's Athletic Council meets monthly during the fall, winter and spring and makes recommendations on athletic policy including ticket prices. December's meeting was at Ohio Stadium.

Gee has gotten in trouble before for offhand remarks, most recently during a memorabilia-for-cash and tattoos scandal under football coach Jim Tressel's watch.

Gee was asked in March 2011 whether he had considered firing Tressel. He responded: "No, are you kidding? Let me just be very clear: I'm just hopeful the coach doesn't dismiss me." Tressel stepped down three months later.

In November 2010, Gee boasted that Ohio State's football schedule didn't include teams on par with the "Little Sisters of the Poor." An apologetic Gee later sent a personal check to the real Little Sisters of the Poor in northwest Ohio and followed up with a visit to the nuns months later.

Last year, Gee apologized for comparing the problem of coordinating the school's many divisions to the Polish army, a remark that a Polish-American group called bigoted and ignorant.

In 1992, in a moment of frustration over higher-education funding, Gee told a student newspaper reporter, "the governor's a damn dummy." Then-Gov. George Voinovich laughed it off, and the two became allies.

Gee was named the country's best college president in 2010 by Time magazine, and he has one of the highest-profile resumes of any college leader in recent history. He has held the top job at West Virginia University, the University of Colorado, Brown University and Vanderbilt University. He was Ohio State president from 1990 to 1997 and returned in 2007.

Gee earns about $1.9 million annually in base pay, deferred and performance compensation and retirement benefits.

He is a prolific fundraiser and is leading a $2.5 billion campaign at Ohio State. He is omnipresent on campus, attending everything from faculty awards events to dormitory pizza parties. He is known for his bow ties — he has hundreds — and his horn-rimmed glasses.

During his comments to the Athletic Council, Gee also questioned the academic integrity of schools in the Southeastern Conference and the University of Louisville.

The top goal of Big Ten presidents is to "make certain that we have institutions of like-minded academic integrity," Gee said. "So you won't see us adding Louisville," which is also joining the ACC.

After a pause followed by laughter from the audience, Gee added that the Big Ten wouldn't add the University of Kentucky, either.

"We understand this is not the first time President Gee has made statements he has regretted," said Louisville spokesman Mark Hebert.

During the meeting, Gee also said he thought it was a mistake not to include Missouri and Kansas in earlier Big Ten expansion plans. Missouri has since joined the SEC.

"You tell the SEC when they can learn to read and write, then they can figure out what we're doing," Gee said when asked by a questioner how to respond to SEC fans who say the Big Ten can't count because it now has 14 members.

Gee noted he was chairman of the SEC during his time as Vanderbilt University chancellor. He also told the audience that speculation about the SEC "remains right here," according to the recording.

Gee took a swipe at Big Ten Commissioner Jim Delany, one of the most powerful leaders in college athletics, when he answered a question about preserving Ohio State's financial interests in light of Big Ten revenue-sharing plans.

"No one admires Jim Delany more than I do. I chaired the committee that brought him here," Gee said. "Jim is very aggressive, and we need to make certain he keeps his hands out of our pockets while we support him."

Delany called the comments "inappropriate."

Four Houston firefighters died Friday while responding to a massive 5-alarm fire at a motel, a city official told FoxNews.com.

The local medical examiner's office says three victims died at the scene, while the fourth died at a hospital. Five others were injured and are hospitalized for chest pains or leg injuries.

MyFoxHouston.com reported that over 100 firefighters battled the blaze in sweltering temperatures.

"The roof collapsed"

The fire broke out just after noon Friday at a restaurant and club at the Southwest Inn on U.S. 59, one of Houston's most heavily traveled expressways. Flames spread to the motel part of the building and were still shooting from the roof of the structure more than an hour later.

Jeff Caynon, the president of the Houston Professional Fire Fighters Association, told The Houston Chronicle that reports from the field indicated that firefighters were injured in a roof collapse.

"The roof collapsed," he told the paper. "I don't know if that was folks outside next to the structure or inside when it collapsed, but the collapse is going to be the cause."

No cause for the blaze was immediately announced. Phone messages left with the fire department weren't immediately returned.

Temperatures in the low 90s and high humidity hampered firefighting efforts, and smoke from the fire snarled traffic on the expressway.

The 100 Club, a Houston-based non-profit organization that supports the dependents of firefighters and law enforcement officers killed in the line of duty, announced it will provide financial assistance for the victims' families.

"It's a very sad day for the Houston Fire Department and the city of Houston as a whole," said Janice Evans, a spokeswoman for Houston Mayor Annise Parker.

DEVELOPING: An extremely unstable air mass has developed across northeast and central Oklahoma Friday afternoon prompting the National Weather Service to issue a rare PDS (particularly dangerous situation) tornado watch.

The prime time and location for damaging hail, winds, and tornadoes will be just west of I-35 into OKC Metro and everywhere east between 4-7 this evening, OKCFOX.com reported.

A huge asteroid is set to cruise by Earth Friday afternoon, making its closest approach to our planet for at least the next two centuries.

Asteroid 1998 QE2 will come within 3.6 million miles of Earth at 4:59 p.m. EDT (2059 GMT) Friday — about 15 times the distance from our planet to the moon.

There's no chance the 1.7-mile-wide 1998 QE2 will hit us, researchers say. That's a good thing, because a strike by such a big space rock would cause catastrophic damage, potentially wiping out our species. [Potentially Dangerous Asteroids (Images)]

In general, scientists think any asteroid bigger than 0.6 miles could end human civilization if it hit us. For comparison, the object that killed off the dinosaurs 65 million years ago is thought to have been about 6 miles wide.

Asteroid 1998 QE2 won't put on a show for skywatchers. At its closest pass, the space rock will still be 100 times fainter than the dimmest star visible to naked-eye observers under clear and dark skies, experts say.

But several different organizations, including the Slooh Space Telescope and the Virtual Telescope Project, will broadcast live views of the near-Earth asteroid's close approach from professional-quality observatories around the world. You can watch it live right here at FoxNews.com, starting at 4:30 p.m. EDT (2030 GMT).

"It will be fun to actually watch it change position," Astronomy magazine columnist Bob Berman, who will participate in Slooh's show, said in a statement. "As Slooh's Space Cameras image it directly [Friday] afternoon, we will all be reminded that asteroids of this size have changed the biosphere of our planet in the past, and even set the stage for the present dominion of humans."

Scientists are already watching 1998 QE2 closely, in an attempt to learn more about the asteroid's characteristics and orbit. A team of radio astronomers using NASA's Deep Space Network antenna at Goldstone, Calif., for example, just learned that the asteroid is actually a binary system, with a 2,000-foot-wide moon circling the larger space rock.

Researchers plan to use the Goldstone facility as well as the huge Arecibo Observatory in Puerto Rico to watch 1998 QE2 through June 9, NASA officials said.

Asteroid 1998 QE2 was first spotted in August 1998 by astronomers working with MIT's Lincoln Near Earth Asteroid Research program in New Mexico. The space rock's name is not an homage to England's Queen Elizabeth II, or to the famous ocean liner. Rather, it's just the moniker assigned under the established alphanumeric scheme that lays out when asteroids are discovered.

The approaching 1998 QE2 is part of a near-Earth population that likely numbers in the millions. To date, just 10,000 of these relatively close-flying space rocks have been discovered.

State Sen. Karen Carter Peterson, the head of the Louisiana Democratic Party, said on the floor of the state Senate this week that opponents of the federal health care overhaul are motivated by President Obama's race. Peterson, who is also chairwoman of the state Democratic Party, then went on to repeatedly bring up race as she railed against ObamaCare critics.

"I have talked to so many members both in the House and the Senate, and you know what? You ready? You ready? What it comes down to? It's not about how many federal dollars we can receive, it's not about that. You ready? It's about race," Peterson said. "I know nobody wants to talk about that. It's about the race of this African-American president."

Personally, I am outraged by Peterson's comments  – and I'm sure many opponents of the health care overhaul are as well. I am an American through and through. My roots are of Latino heritage – which I happen to be very proud of – and I will not tolerate being called a racist. I have cared for and treated minority patients throughout my career as a doctor.

My criticisms of ObamaCare are based on facts. It is a poorly executed plan, the American public was not informed and the agenda that was implemented behind the passing of this legislation is not one that I agree with. That is why I criticize ObamaCare.

If race is the best argument that a Democratic leader can come up with to explain why so many people are opposed to this new law, then they've got a lot of work to do.

My home is a rainbow of colors. My children have been raised in a multicultural environment and I am very proud of how we have raised them to form opinions based on fact – not emotion.

Peterson did release a statement on Thursday afternoon that was intended to clarify her remarks. However, she also seemed to defend them.

"I think we should judge a policy by its content, not the person proposing it," her statement said. "To be clear, I didn't call any person 'racist.' Rather, I was simply relaying the truth about conversations I've had with my colleagues and the factors they considered on the expansion of Medicaid. While others are using this as an opportunity to take my comments out of context in order to distract from the true issue, I think it's critical that we focus on the substance of the policy because it's the right thing to do for Louisiana."

But making a statement after the fact is easy. I don't want an apology from State Sen. Peterson, what I want is for her to look the American public in the eye and explain her remarks.

WASHINGTON –  A controversial proposal in New York City to give voting rights to hundreds of thousands of non-citizen immigrants could make them into a key vote in America's largest city.

The Big Apple proposal, though, could resonate with other municipalities, inspiring them to follow suit -- and, if Congress approves an otherwise unrelated immigration overhaul, the number of newly eligible immigrant voters could swell into a potent voting bloc on the local level. 

That's because the national overhaul being considered in Washington creates a so-called pathway to legal status for millions of illegal immigrants. By itself, this does little in the near-term to give non-citizens the right to vote. But if New York City approves its plan to give its 800,000 legal immigrants a say in city politics, illegal immigrants could eventually join the voter rolls there as well. And they wouldn't have to wait for citizenship to vote.  

The idea is a controversial step in a decades-long debate over who should have a say in how their cities are run. Already, four Massachusetts towns and a half-dozen cities in Maryland allow non-citizen immigrants to vote on a local level. 

Others, though, wonder whether these measures could unfairly funnel in those voters to make significant changes. 

"This isn't about voting rights and democracy," Bob Dane, communications director at the Federation for American Immigration Reform, told FoxNews.com. "This is a push to sign up Democrats." 

New York Democratic Councilman Daniel Dromm is behind the bill that would open all city elections to immigrants with a green card. His proposal is gaining ground and if passed, would make The Big Apple the first major city in the country to give non-citizens the right to vote. 

"That would make those people much more civically engaged in the community and have a stake in the decision-making process and so that's really the purpose of this legislation," he told PRI's The World, a New York radio show. "As it stands now, one in five New Yorkers cannot participate in municipal elections because they are recent immigrants. This law would change that." 

Dromm, whose office refused nearly a dozen interview requests from FoxNews.com, could benefit if the proposal passes. Immigrants who are now ineligible to vote make up 68 percent of the Queens district he represents. 

Jamie Chandler, a political science professor at Hunter College, said the bill "will probably give progressive candidates and progressive lawmakers an even stronger position." In New York, for every GOP voter, there are five Democratic ones. 

Giving immigrants a ticket to the voting booth would likely solidify any political lead he'd have over his conservative opponents, who generally disagree with the idea of widening the eligibility criteria. 

Dromm's plan would welcome people who have been living in the country legally for at least six months to participate in city elections. They would be registered as "municipal voters." 

According to the legislation, the law would go into effect six months after it passes. It is unlikely to affect the upcoming mayoral elections later this year. This group of new voters would eventually be able to choose the mayor, comptroller, public advocate, members of the city council and borough presidents. They would also get a say in all municipal ballot measures and be granted the same rights and privileges as citizen voters with regard to municipal elections.

These voters would not be allowed to participate in national elections. And under the separate immigration overhaul being considered in Washington, any illegal immigrant who is legalized would have to wait 10 years before applying for green cards. 

So the impact on the voter rolls would not be immediate. 

New York City Mayor Michael Bloomberg, though, doesn't like the idea. 

"Voting is the most important right we are granted as citizens, and you should have to go through the process of becoming a citizen and declaring allegiance to this country before being given that right," he said in a written statement obtained by FoxNews.com. 

Dromm has disputed that, arguing that non-citizens had been able to vote in the past.   

In New York City, non-citizens had been able to vote for the school board for three decades, until Bloomberg disbanded the board itself when he took office 11 years ago. During the last mayoral election, only 29 percent of the voters turned out. It was a 40-year low. 

If Big Apple lawmakers go through with their more inclusive voting plan, it would make the city the largest in the country to dramatically widen its local voting base. To date, though, there has not been a calendar date set for when NYC council members might vote on the bill. 

Michele Wucker, president of the World Policy Organization, supports the New York City plan. 

"If you have people who want to get involved in civic life, why wouldn't you want to encourage that?" she said. 

Wucker says letting legal immigrants vote in local city elections would most likely lead to them putting down roots in the community and eventually becoming citizens. But it's a process, she said, that won't be done overnight.   

"Many states would have to change their constitutions to make it happen," Wucker said. 

Presently, four Massachusetts towns have OK'd plans to let immigrants vote but are still waiting for approval on the state level. In Maryland, six small cities are pushing forward with their plans. 

New York City would not need to wait for such approval. 

But it's not all smooth sailing. Immigrant suffrage initiatives were shot down two years ago in San Francisco and in Portland, Maine. There are signs that parts of Portland could be reversing its stance. 

Last week, Portland Mayor Michael Brennan went on a listening tour of immigrant-owned businesses in the city. Brennan has thrown his support behind a sweeping immigration reform bill in the state. Brennan's tour included stops at a taxi company, restaurant and grocery store. 

Calls to Brennan's office for comment were not immediately returned.

    Dr. Shakil Afridi has helped the U.S., but now his supporters say the U.S. must do more to help him.

It was the Obama administration that sealed the fate of the Pakistani doctor jailed for helping nail Usama Bin Laden, by divulging key details after the fact and dooming any chance Shakil Afridi's cover story could win his freedom, according to a confidential Pakistani report.

When former Secretary of Defense and ex-CIA Director Leon Panetta publicly acknowledged Afridi's role in the ruse which helped the CIA pinpoint Bin Laden's presence in an Abbottabad compound, any chance that Pakistani authorities could help him get out of the country vanished, according to what some have called Pakistan's version of the 9/11 Commission, a 357-page report from an independent body set up to probe the aftermath of the 2011 raid by Navy SEALs in which the Al Qaeda leader was killed.

"The statement by the U.S. Defense Secretary Leon Panetta, who was the CIA Director when May 2 happened, confirming the role of Dr. Afridi in making the U.S. assassination mission a success, rendered much of what Afridi told the Commission very questionable if not outright lies," states the report, which has not been released, but which FoxNews.com has viewed.

"The lesson from the Afridi episode is, if it suits the political purpose of the Obama administration, you'll be exposed and placed in jeopardy."

Indeed, Panetta and others in the Obama administration were sharply criticized domestically for discussing the raid and efforts involving Afridi to obtain DNA from the compound's occupants by posing as a medical team offering vaccinations. Nearly five months before Afridi's sentencing, while the doctor was being held and interrogated by Pakistan's shadowy intelligence agency , Panetta spoke on record in an interview to CBS "60 Minutes" confirming Afridi's role in late January 2012. The statements came after Afridi had testified to the commission, and sharply contradicted his story.

"This was an individual, in fact that helped provide intelligence, that was very helpful in regards to this operation and he was not in any way treasonous towards Pakistan," Panetta told the program in January, 2012, in the first acknowledgement of Afridi's role. 

That prompted the Pakistani commission to conclude in its report that "Dr. Afridi had been cultivated by the CIA and ultimately used in its project to assassinate Usama Bin Laden."

Panetta did not respond to multiple requests for comment. His spokesman, Jeremy Bash, had earlier told a Fox News Channel correspondent that Panetta wasn't willing to talk to media.

Rep. Dana Rohrabacher, R-Calif., Afridi's most vocal supporter in Congress, has been critical of the Obama administration's handling of Afridi's case. But he said he is skeptical of the report placing all the blame for his imprisonment on the U.S. 

"It doesn't take genius to figure out that the Pakistanis have been betraying us all along and Dr. Afridi is being used as a pawn in their game with the United States," Rohrabacher said.

The Commission Report itself recommends a retrial for Afrid, who is now appealing his case. His family is holding out hope that American pressure can win his freedom, while his U.S. supporters have been critical of the Obama administration and State Department for its muted approach to the matter.

"We need to continue to put pressure on the Obama administration and the State Department to advocate for the immediate release of Dr. Afridi, not just a retrial," said Rohrabacher, who wants the doctor to be recognized as an American hero

Afridi's lawyer in North West Pakistan has argued that Panetta's statement further complicated an already convoluted matter concocted on trumped up charges without laying blame on U.S. or Pakistan. Afridi is serving a 33-year term in Peshawar Central Jail after being convicted by a tribal council of colluding with local militant group Lashkar-e-Islam. American lawmakers, diplomats and administration officials all believe the charges are a proxy for his role in assisting a foreign spy agency.

"The lesson from the Afridi episode is, if it suits the political purpose of the Obama administration, you'll be exposed and placed in jeopardy," said Thomas Fitton, president of Judicial Watch.

Panetta's disclosure robbed Afridi of "plausible deniability" of a role in the episode. Even if Pakistani officials did not believe Afridi's account, his story may have provided cover for a diplomatic solution had Panetta not undermined it, he said.

The U.S. intelligence community was alarmed at the Obama administration's loose-lipped attitude toward the raid, according to New York Times reporter David Sanger's book "Confront and Conceal," which claimed leaks prompted then-Secretary of Defense Robert Gates to angrily confront Obama's National Security Advisor Thomas Donilon.     

"I have a new strategic communications approach to recommend," Gates is quoted as telling Donilon. "Shut the f@*k up!"

In addition to Panetta's interview, Kathryn Bigelow, director of "Zero Dark Thirty" the Hollywood movie which depicts "Operation Neptune" that killed Bin Laden, was given exclusive access to classified information.

Administration seeks to bring detainee to US for military trial, sources say

The Obama administration is looking to transfer a detainee who is being held overseas and is said to have "blood on his hands" to the U.S. for a military trial, sources close to the military commission process tell Fox News. 

The move could be a test case for bringing detainees captured overseas to America for military commissions. It comes as the administration claims to be reining in its drone program, which critics say amounts to a kill program -- with top terrorists rarely being captured for interrogation or trial. 

Sources say the detainee in this case is a relatively new capture, who has "no taint associated with interrogations" that could complicate a military proceeding inside the U.S. The detainee would likely be prosecuted on war crimes charges. 

The administration has already moved to prosecute some alleged terrorists captured overseas in federal court. But Fox News is told that prosecuting this detainee in federal court was deemed unlikely based on the available evidence. 

The identification of the detainee came after a fact-finding team traveled overseas. Sources told Fox News the team's destination was believed to be Afghanistan where detainees, described as EST's (enduring security threats), are being held. 

At a May 15 hearing before the House Judiciary Committee, Republican Iowa Rep. Steve King asked Attorney General Eric Holder if he was aware "of any plans or any discussion" to transfer one of more detainees from Afghanistan to the United States for trial. 

"Nothing immediately comes to mind," Holder responded. "I'm not aware of that." 

When King pushed further, and asked if there were any discussions to bring detainees "out of the theater in the global war on terror" to the U.S. for trial, Holder again insisted he didn't know. 

"Not that I'm aware of as we speak. I'd have to look into that, and if I have a contrary answer to that, I will get you something in writing," he said. 

Asked for comment, Defense Department spokesman for legal affairs Todd Breasseale reiterated that President Obama has asked the Defense Department to designate a site inside the U.S. for military commissions, and is appointing a group of envoys to negotiate the transfer of detainees to third countries. 

"As for the specifics of any future state-side prosecutions in such a system, I'm afraid I simply have nothing for you on this," he told Fox News. 

Obama made the call for a military commissions site in a major counterterrorism policy speech last week. It's unclear where the detainee in this case would be sent. 

A White House spokeswoman for the National Security council had no comment and referred Fox News to the Defense Department.

'TARGET' PRACTICE: Claims IRS Scrutiny Went Beyond Tea Party Grow

What started as a scandal over the IRS's targeting of conservative groups has broadened, with lawmakers and other critics now questioning whether other kinds of organizations were unfairly flagged for additional scrutiny. 

Rep. Sam Graves, R-Mo., chairman of the House Small Business Committee, wrote a letter to Acting IRS Commissioner Daniel Werfel on Friday asking a series of questions about the agency's audit practices for small businesses. 

He made no specific allegation, but said that lawmakers' investigations to date prompted the letter. 

"(Congressional) investigations have only raised more questions as to the extent these practices may have extended beyond conservative groups," Graves wrote. 

Indeed, the scope of the IRS' heavy auditing and scrutiny appears to go beyond Tea Party groups. 

A report by the IRS' Taxpayer Advocate Service found the IRS improperly targeted adoptive families -- flagging for further review 90 percent of those who claimed the adoption tax credit in 2012. Further, nearly 70 percent of them endured at least a partial audit of their returns. 

By contrast, just one percent of all returns are audited. 

The report fueled concerns that the IRS is unfairly lumping categories of filers together for additional review, in turn scrutinizing small-fry individuals and groups while ignoring bigger and richer organizations. 

The allegations have been cascading in from across the country as Congress investigates. First, religious groups claimed they had been subjected to additional scrutiny as well. In one high-profile letter from a Christian leader, Franklin Graham alleged that the Billy Graham Evangelistic Association and one other group had been flagged in 2012 for additional review. Graham claimed the reviews were not "justifiable." 

The Washington Free Beacon also reported Thursday that at least five pro-Israel organizations were audited by the IRS following a campaign by White House-aligned group to challenge their tax-exempt status. 

Those pro-Israel groups came under criticism after they challenged the administration's stance against Israeli settlement construction. 

The Hill also reported on Friday that aid groups trying to help those caught in the Syrian civil war are facing long delays in their applications for tax-exempt status. 

This is similar to the problem faced by Tea Party and other groups, who had their applications tied up for a roughly 18-month stretch. 

Current and former IRS officials have said that while the practice of subjecting those groups to additional scrutiny was inappropriate, it was not politically motivated. Rather, they say the criteria were developed to deal with an influx of cases. Others have suggested it is up to Congress to clarify the rules for the IRS. 

An IRS official last week defended the scrutiny of adoptive families, arguing that the agency is obligated to make sure claims are accurate. 

"The IRS implemented the adoption credit program with an approach that balanced the objective of paying legitimate credits in a timely manner with that of ensuring that claims were accurate," IRS spokeswoman Michelle Eldridge said in a statement to FoxNews.com. "Our experiences and lessons learned from other refundable credits taught us that high dollar credits have high risk and the potential for fraud. We must ensure delivery of the credit to those entitled while protecting the government's interest in minimizing exposure to fraud." 

In 2011, more than 51,000 taxpayers claimed $668 million from the adoption tax credit. This was after the health care law increased the maximum credit per child. 

However, the extra audits only found $11 million in improper claims from the 2011 year. 

The taxpayer advocate report said the practice "caused significant harm to thousands of families who are selflessly trying to improve the lives of vulnerable children." 

The IRS will be in the hot seat once again next week to answer questions on its targeting practices, as Congress plans at least two upcoming hearings on the scandal. Meanwhile, a recent poll showed Americans overwhelming want an outside investigator to be assigned to examine the IRS. The Justice Department already has launched its own probe.

If you smoke or you're overweight, have high cholesterol or high blood pressure, you could be forced to pay a lot more for health insurance, according to new regulations just issued by the Obama administration.

"For smoking, for being overweight, for being obese and basically, for generally not meeting the health guidelines, the employer can charge 30 percent more - for smoking, 50 percent more," explains John Goodman, President of the National Center for Policy Analysis in Dallas.

ObamaCare does prevent insurers from charging more for pre-existing conditions, or from charging as much as they currently do for older people who use more health care.

But when it comes to smoking and being overweight as well as other health problems, if employees don't participate in wellness programs, they could pay more.

Ed Haislmeier of the Heritage Foundation says "on the one hand they're trying to ban discrimination based on health status, but on the other hand they're trying to say that some discrimination based on health status is good discrimination."

Goodman adds that "it is definitely the nanny state trying to tell us what we're going to do, and unleashing the employers to be the agent of the government in telling us what we're going to do."

Smokers, of course, run up more health care bills than non-smokers. But that habit and some other unhealthy conditions are associated with lower incomes, so higher rates would hit those the administration was aiming to help.

"Allowing premium differentials based on these factors will push premiums higher primarily on people that will be struggling to pay the premiums in the first place," says Jim Capretta of the Ethics and Public Policy Center.

Many employers already offer wellness programs, but the new 123-page regulation tells them exactly how they must operate.

"This is just one more massive regulation on top of the thousands and thousands of pages that have already been issued that employers have to deal with," says Capretta. "I think the whole system is starting to choke on so many rules."

Ironically, on the day officials released the new regulations, a Rand Corporation study about wellness programs was released – and not with good news.

Goodman noted it was "a Rand Corporation study, which was paid for by the Obama administration, and called for in the affordable care act.

"And the Rand Corporation has studied wellness programs all over the country, and basically says they don't work."

In fact, the study found that those trying to lose weight in these programs lost an average of a pound a year. And although some employers offer gym memberships, those who take them are the ones using the gym already -- not those who need it most.
