The parents of a 10-year-old girl who urgently needs a lung transplant have filed a lawsuit asking a federal judge to change organ-donation rules for children.

Lawyers for Janet and Francis Murnaghan filed the lawsuit Wednesday in Philadelphia. They say existing rules discriminate against children under the age of 12 by giving older candidates priority for donated adult lungs.

Joel Newman, a spokesman for the Virginia-based United Network for Organ Sharing, says he isn't aware of any previous court action that had "a material effect" on a transplant case.

On Tuesday, U.S. Health and Human Services Secretary Kathleen Sebelius declined to intervene.

The lawsuit seeks an emergency hearing and an order changing the rules. The lawyers say Sarah Murnaghan will die soon without new lungs.
