The independent contractor that hired Washington Navy Yard shooter Aaron Alexis knew he was showing signs of mental illness, but failed to report the finding—despite rules requiring them to do so, according to congressional testimony Thursday.

Stephen Lewis, a Deputy Director for the Office of the Undersecretary of Defense told the Senate Committee on Homeland Security and Governmental Affairs that it was determined that the company, The Experts, was well aware of Alexis's mental instability and failed to report the information.

In addition, the contractor failed to seek out a copy of a police report for a 2004 arrest in Seattle when Alexis allegedly shot out the tires of a car in what was described as a rage "blackout." However, his employer was not obligated to seek out the report under current criteria for background checks on an individual.

"It was not in our view, a case of malfeasance on the part of the contractor. They did what they were supposed to do," Brenda Farrell, Director of Defense Capabilities and Management at the Government Accountability Office said during her testimony.

Thursday's hearing was meant to examine the adequacy of background checks and the security clearance system for federal employees and contract workers. It comes as officials investigate how Alexis, a 34-year-old defense contractor, was able to acquire and maintain a secret clearance despite a series of violent outbursts, repeated brushes with the law and concerns about his mental health.

The former Navy reservist killed 12 people inside the Navy Yard building where he worked Sep. 16 before being fatally shot by police. He entered the property with a valid security badge.

President Barack Obama has also ordered the White House budget office to examine security standards for government contractors and employees across federal agencies. Concerns about weaknesses in the security clearance system have surfaced not only with Alexis, but also with National Security Agency leaker Edward Snowden and Army Pvt. Bradley Manning, currently imprisoned for leaking classified documents.

One revision discussed Thursday is the process by which security clearance holders are re-investigated. That currently happens every five years for those with top secret clearances and every 10 years for holders of secret clearances.

A new tool emerging from an executive order would allow that review to happen at any time, including automated records checks of government and commercial databases, said Brian Prioletti, an assistant director in the Office of the Director of National Intelligence.

Defense officials have said that when Alexis applied for security clearance with the Navy, he lied about the 2004 arrest in Seattle.

An FBI fingerprint check revealed the arrest, but an investigative report from an Office of Professional Management contractor omitted the fact that Alexis had fired shots, court records in Seattle did not detail the circumstances of the arrest, and no charges were filed.

Alexis was granted a secret clearance in 2008 and held onto it despite multiple subsequent encounters with police, including a 2010 arrest in Texas, where a neighbor told police she was nearly struck by a bullet fired from his downstairs apartment. No charges were filed.

Elaine Kaplan, acting director of the OPMt, said her staff has advised her that Alexis's file "complied with all applicable standards," but that OPM's office of internal oversight and compliance is reviewing the matter.

One month before the Navy Yard shooting, Alexis called police in Rhode Island to the hotel where he was staying and complained about voices wanting to harm him, according to the police report. The FBI has said he believed he was being bombarded with extremely low frequency radio waves.

Notes from an Obama administration meeting about the problem-plagued ObamaCare website indicate only six people signed up for the health care law on its first day, according to documents released by the House Oversight and Government Reform Committee.

Fox News' Ed Henry told Megyn Kelly on "The Kelly File" Thursday that the documents, released by committee Chairman Rep. Darrell Issa, are not official enrollment numbers, but say that as of the morning of Oct. 2, "six enrollments have occurred so far with five different issuers."

The notes were taken at a "war room" meeting of the Center for Medicare and Medicaid Services, which has been tasked with implementing ObamaCare.

They say that at the next meeting, which took place on the afternoon of Oct. 2, "approximately 100" people had signed up and 248 enrollments had occurred by the morning of Oct. 3.

The Obama administration has thus far not released any official numbers on ObamaCare enrollment, saying the first numbers would be released in mid-November after the HHS collects data from a variety of different sources.

A HHS spokesman told Fox News the documents "appear to be notes," and do not include official enrollment statistics.

"As the Secretary said before Congress, we are focused on providing reliable and accurate information and we do not have that at this time due to the issues with 834 forms," Joanne Peters said. "We have always anticipated that the pace of enrollment will increase throughout the enrollment period."

Health care industry consultant Robert Laszewski told Kelly the numbers are not surprising, saying "clearly the White House does not want insurance companies talking about what's going here."

"And given what was released tonight, the news that so very few people are signing up, you can see why," he continued. "If four weeks ago the enrollment numbers were public it would look very bad. I can tell you based upon the information that I continue to get this trickle of enrollment that you're reporting on for the first three days has really continued for the first month."

The House Oversight and Government Reform Committee received the documents in response to its request to 11 of the contractors involved in the ObamaCare website rollout.

SANTIAGO, Chile –  A strong earthquake has rocked central Chile, causing buildings to sway in the capital of Santiago. There were no immediate reports of major damage or deaths.

The U.S. Geological Survey is reporting that the quake had a magnitude of 6.6, and its epicenter was located about 40 miles southwest of the city of Coquimbo. It's depth was 6 miles.

Chile is one of the world's most earthquake-prone countries. A magnitude-8.8 quake and the tsunami it unleashed in 2010 killed more than 500 people and destroyed 220,000 homes.

A federal appeals court issued a ruling Thursday reinstating most of Texas' controversial new abortions restrictions, just three days after a federal judge ruled they were unconstitutional. 

The decision by the panel of judges at the 5th Circuit Court of Appeals means as many as 12 clinics won't be able to perform the procedure starting as soon as Friday.

The panel said the law requiring doctors to have admitting privileges at a nearby hospital can take effect while a lawsuit moves forward. The restrictions could take effect Friday.

The panel left in place a portion of District Judge Lee Yeakel's order that prevents the state from enforcing the U.S. Food and Drug Administration protocol for abortion-inducing drugs in cases where the woman is between 50 and 63 days into her pregnancy. Doctors testifying before the court had said such women would be harmed if the protocol were enforced.

Texas Attorney General Greg Abbott had made an emergency appeal to the conservative 5th Circuit, arguing that the law requiring doctors to have admitting privileges is a constitutional use of the Legislature's authority.

Abbot said in a statement Thursday that "this unanimous decision is a vindication of the careful deliberation by the Texas Legislature to craft a law to protect the health and safety of Texas women."

Lawyers for Planned Parenthood and other abortion providers had argued that the regulations did not protect women and would shut down a third of the abortion clinics in Texas.

The court's order is temporary until it can hold a complete hearing, likely in January. The restrictions are among the toughest in the nation and gained notoriety when Democratic state Sen. Wendy Davis launched a nearly 13-hour filibuster against them in June. 

The law also bans abortions at 20 weeks of pregnancy and beginning in October 2014 requires doctors to perform all abortions in surgical facilities.

During the trial, officials for one chain of abortion clinics testified that they've tried to obtain admitting privileges for their doctors at 32 hospitals, but so far only 15 accepted applications and none have announced a decision. 

Many hospitals with religious affiliations will not allow abortion doctors to work there, while others fear protests if they provide privileges. 

Many have requirements that doctors live within a certain radius of the facility, or perform a minimum number of surgeries a year that must be performed in a hospital.

A controversial 600-plus page manual used by the military to train its Equal Opportunity officers teaches that "healthy, white, heterosexual, Christian" men hold an unfair advantage over other races, and warns in great detail about a so-called "White Male Club."

"Simply put, a healthy, white, heterosexual, Christian male receives many unearned advantages of social privilege, whereas a black, homosexual, atheist female in poor health receives many unearned disadvantages of social privilege," reads a statement in the manual created by the Defense Equal Opportunity Management Institute (DEOMI).

The manual, which was obtained by Fox News, also instructs troops to "support the leadership of people of color. Do this consistently, but not uncritically," the manual states.

The military manual goes into great detail about a so-called "White Male Club."

The Equal Opportunity Advisor Student Guide is the textbook used during a three month DEOMI course taught at Patrick Air Force Base in Florida. Individuals who attend the training lead Equal Opportunity briefings on military installations around the nation.

The 637-page manual covers a wide range of issues from racism and religious diversity to cultural awareness, extremism and white privilege.

I obtained a copy of the manual from an Equal Opportunity officer who was disturbed by the course content and furious over the DEOMI's reliance on the Southern Poverty Law Center for information on "extremist" groups.  

"I'm participating in teaching things that are not true," the instructor told me. He asked not to be identified because he feared reprisals.

"I should not be in a position to do that," he said. "It violates Constitutional principles, but it also violates my conscience. And I'm not going to do it – not going to do it."

DEOMI instructors were also responsible for briefings at bases around the country that falsely labeled evangelical Christians, Catholics and a number of high-profile Christian ministries as domestic hate groups.  

I contacted the Pentagon as well as the DEOMI multiple times for comment on this story, but so far they have not responded to my requests.

DEOMI opened in 1971 in response to the civil rights movement. It's responsible for Equal Opportunity/Equal Employment Opportunity education and training for military active duty and reservists, according to its website.

The subject of white privilege emerged in a 20-page section titled, "Power and Privilege."

"Whites are the empowered group," the manual declares. "White males represent the haves as compared to the have-nots."

The military document advises personnel to "assume racism is everywhere, every day" and "notice code words for race." They are also instructed to "understand and learn from the history of whiteness and racism."

"Assume racism is everywhere, everyday," read a statement in a section titled, 'How to be a strong 'white ally.'"

"One of the privileges of being white is not having to see or deal with racism all the time," the manual states. "We have to learn to see the effect that racism has."

On page 181 of the manual, the military points out that status and wealth are typically passed from generation to generation and "represent classic examples of the unearned advantages of social privilege."

"As such, the unfair economic advantages and disadvantages created long ago by institutions for whites, males, Christians, etc. still affect socioeconomic privilege today," the manual states.

The guide also points out that whites are over-represented and blacks are underrepresented in positive news stories, that middle class blacks live in poorer neighborhoods than middle class whites and that even though there are more white criminals than any other race, the news coverage of black criminals is about equal to the news coverage of white criminals.

The military manual goes into great detail about a so-called "White Male Club."

"In spite of slave insurrections, civil war, the 13th, 14th, and 15th amendments, the women's suffrage movement leading to the 19th amendment, the civil rights movement, urban rebellions and the contemporary feminist movement, the club persists," the document states.

DEOMI states that "full access to the resources of the club still escape the vision of equitable distribution."

The military also implies that white Americans may be in denial about racism.

In a section titled, "Rationalizations for Retaining Privilege and Avoiding Responsibilities," the military lays out excuses white people use.

"Today some white people may use the tactic of denial when they say, 'It's a level playing field; this is a land of equal opportunity,'" the manual reads. "Some white people may be counterattacking today by saying political correctness rules the universities or they want special status."

DEOMI points out that if "white people are unable to maintain that the atrocities are all in the past, they may switch to tactics to make a current situation seem isolated."

They said some of the ways whites may claim to be victims include saying things like, "I have it just as bad as anyone else," "They're taking away our jobs," or "White people are under attack."
The military concludes the section by urging students to "understand and learn from the history of whiteness and racism" and "support the leadership of people of color."

I called former Congressman and Lt. Col. Allen West (ret.) to get his take on the manual. In a nutshell – he wants a congressional investigation.

"This is the Obama administration's outreach of social justice into the United States military," he told me. "Equal Opportunity in the Army that I grew up in did not have anything to do with white privilege."

West said he is very concerned about the training guide.

"When the president talked about fundamentally transforming the United States of America, I believe he also had a dedicated agenda of going after the United States military," he said. "The priorities of this administration are totally whacked."

West said the DEOMI manual reminded him of a similar program inflicted on the military by President Clinton.

"They came down with a new training requirement called, 'Consideration of Others Training,'" he said. "The soldiers were supposed to sit around and go through vignettes and talk about their feelings."

I truly wish the Pentagon and the DEOMI would return my telephone calls. I'd like to know how teaching soldiers, airmen and sailors about white privilege and fomenting racial division helps them protect our nation from the enemy.

The parents of a Georgia teenager, whose body was found inside a rolled-up wrestling mat in his high school gym, believe their son was murdered, the family's attorney said Thursday.

Kendrick Johnson, of Valdosta, Ga., was found Jan. 11 stuck in an upright mat propped behind the bleachers inside his high school gym. Lowndes County sheriff's investigators concluded Johnson died in a freak accident, but the 17-year-old's family disputes that. 

"They absolutely think their son was murdered," Benjamin Crump, an attorney representing Kenneth and Jacquelyn Johnson, told FoxNews.com.

"They never believed he died the way the sheriff concluded. They believe that it defies logic, the laws of physics as well as common sense," Crump said. "They think this is a cover-up to protect the person or people responsible for their son's death."

"They sent their son to school with a book-bag and he was returned to them in a body bag," he said. 

U.S. Attorney Michael Moore said Thursday he is conducting a formal investigation into Johnson's death, noting that several key questions remain unanswered.

"What was the cause of death? Was his death the result of a crime?" Moore said at a press conference Thursday afternoon. "I will follow the facts wherever they lead. My objective is to discovery the truth."

"I am of the opinion that a sufficient basis exists" for a formal investigation, he said. 

Moore told reporters that the initial autopsy indicated Johnson died as a result of "positional asphyxia." A second autopsy, however, listed a different cause of death, according to Moore. 

"There are several questions that must be answered or confirmed," he said. 

Moore added that if he uncovers sufficient evidence to warrant a criminal or civil rights investigation into the death of Johnson he will ask the FBI to conduct it.

A representative from the Lowndes County Sheriff's Office was not immediately available for comment when contacted Thursday. 

A southern Georgia judge on Wednesday ordered authorities to release all surveillance video that investigators reviewed. The teenager's parents said they hope the video footage will contain clues to how he died.

Ex-funeral home worker charged with stealing gold teeth from bodies

A former funeral home worker in California has been charged with picking through the mouths of the dead to steal gold teeth.

Prosecutors allege that Pete Jacob Lara, a 39-year-old who worked as an embalmer at a funeral home in Lancaster, was behind a string of thefts between June 25, 2012 and Oct. 28, 2013.

They say he took teeth, a cremation urn box and medallions used to decorate urn boxes worth more than $1,000 and pawned them off, the San Gabriel Valley Tribune reports.

Lara has been charged with removal or possession of dental gold from human remains, grand theft by embezzlement and possession of a controlled substance, methamphetamine, KTLA reports, citing the Los Angeles District Attorney's office.

Lara pleaded not guilty in court on Wednesday and will return on Nov. 12.

Christmas has come early for an Ohio boy whose community has rallied around him in his fight against an aggressive form of brain cancer.

Devin Kohlman, 13 and a resident of Port Clinton, has been battling the cancer for more than a year, but doctors have told his family that chemotherapy isn't working and he may only have a few weeks left to live, Toledo News Now reports.

"We want Devin to have the best Christmas that he's ever had," said his mother, Alexis Kohlman. "And we want to make sure that he has Christmas."

The community answered her wish, throwing a celebration with hundreds decorating the city and filling the streets with Christmas spirit.

"You'll be the one who gets the moon this year."

Devin returned home from a Cincinati hospital Sunday and was greeted by well-wishers at his home in the center of Port Clinton. The next morning volunteers decorated a gazebo and set up a Christmas tree in a nearby park, placing a star on the tree with the words "Merry Christmas Devin," the Port Clinton News Herald reports. City workers trimmed a tree along a street to make sure Devin could see it from his window.

On Monday afternoon, hundreds of residents, with some dressed in Santa hats, gathered outside Devin's home to sing Christmas carols including "We Wish You a Merry Christmas" and "Jingle Bells."

The crowd then paused for a moment to say a prayer before Santa and an elf arrived -- on the backs of motorcycles -- along with several members of the Lost Riders motorcycle club, the Port Clinton News Herald reports.

Santa visited Devin, who was sitting inside his home on a hospital bed. Walmart is funding all the family's Christmas gifts this year, according to Toledo News Now.

"You'll be the one who gets the moon this year," Santa told Devin.

"I've never seen anything like it," Alexis Kohlman told Toledo News Now. "We're really thankful. But it's for Devin. It's not for us."

Port Clinton Mayor Vincent Leone said he was "overwhelmed" at the number of volunteers who participated in the celebration.

"We wanted to make sure that [Devin] knew he had the support of his community – that we really cared about him," he said on Fox News' Happening Now. "We are not unique to any other small town. I think in small towns you always have that closeness, everyone pretty much knows each other."

"I know the Lord has his hand," he added.

An Illinois police officer and his K-9 partner were killed in a crash Wednesday night on I-55 in downstate Illinois, MyFoxChicago.com reported.

Casey J. Kohlmeier, an officer for the Pontiac police, and his K-9 partner Draco were stopped in the I-55 median turn-around north of Route 23 when a vehicle northbound on the interstate struck the marked squad car, a police statement said. Kohlmeier, 29, and Draco were both killed.

The driver of the other vehicle was hospitalized, though details on his condition were not immediately available, according to police.

Kohlmeier, a veteran of the U.S. Air Force, was hired by the Pontiac police force in January 2007 and was assigned to the Livingston County Pro-Active Unit, the statement said.

"Casey was a dedicated, honorable employee who was deeply committed to law enforcement and to the community. He will be greatly missed," the statement said.

U.S. Special Forces have ramped up their efforts to help track and locate notorious African warlord Joseph Kony in the nearly two years since an upstart NGO released a viral video campaign calling for his capture.

The troops have been on the ground in the Congo region for two years, simply assisting local troops across four countries in the region, but they recently have expanded their efforts to capture Kony, leader of the guerilla group the Lord's Resistance Army. Their frontline efforts may be due to the recent KONY 2012 campaign by the California-based group Invisible Children.

"We are encouraged by the way that our work may have been a factor," Ben Keesey, co-founder of Invisible Children, told FoxNews.com. "If you look at all the factors in bringing someone to justice, Joseph Kony and the LRA checks all the boxes."

Kony, one of the world's most infamous war criminals, has used his LRA to decimate villages across the Congo region and abducted and tortured young children, sometimes forcing them to be soldiers against their will. Since Kony's exploits have been brought to the world's attention, there has been a 57% decrease in abductions.

Last month, the Special Forces led four dozen South Sudanese troops deep into the heart of the Congo to locate a crudely-erected LRA encampment. The assault was the first time the U.S. advisers provided support on the ground.

Kony is believed to be hiding in the lawless Central African Republic but U.S. soldiers have increased support to Ugandan troops seeking the war criminal and have increased training of South Sudanese and Congolese troops involved in the hunt.

Senior officials told the Washington Post in a recent report that the Pentagon has asked for  White House approval to temporarily base Osprey aircraft in Uganda to allow both American and African troops to move quickly to assault Kony's encampments.

"We're at a new stage in this mission," Col. Kevin Leahy, who commands the 100 Special Operations troops assisting in the efforts, told the newspaper. "All of the pieces are coming together, and we're pushing on all fronts."

Under rules imposed by the current administration, the Special Ops troops assisting in the pursuit are not allowed to conduct a unilateral mission, with their role limited to training and advising African troops. While being on the front lines is not a violation, in event of a battle, American troops must pull back and can only fire their weapons in self-defense.

The U.S. forces have formed an unconventional alliance with Invisible Children in the two years since the group launched its campaign to bring attention to Kony. They have also coordinated with two American philanthropists who are paying for tracking dogs to accompany the African forces. The ramped-up efforts have greatly narrowed the hunt for Kony.

"Back in March we thought that there might be a setback when the Central African Republic was overthrown by another warlord," Keesey said. "But the U.N. and even Secretary (of State John) Kerry really worked hard to keep the coalition efforts together."

It is believed that they are closing in on Kony's trail. He was driven out of Sudan, a long time safe-haven for the tyrant, and reports have suggested that he is losing his foothold on the Congo region as many LRA soldiers are defecting or surrendering.

"It's hard to give a time frame to when he will be captured. While he no longer can hide in the Sudan, Kony still exploits some of the poorest regions on the planet," Keesey said. "But it's really an encouraging time where we can see more and more progress made towards his capture."

A string of embarrassing episodes for the Obama administration that the president didn't seem to know about until the public did is raising questions about why he wasn't in the loop and who should have told him.

Knowledge that the IRS was excessively targeting Tea Party groups and other conservative organizations during the 2012 election cycle arguably would not reach the president's desk before the news media learned this spring.

But reports over the past week weeks that President Obama was not aware of the National Security Agency monitoring German Chancellor Angela Merkel's cell phone nor of the technical problems that plagued the ObamaCare website ahead of its Oct. 1 launch suggests he is taking too much of hands-off approach or perhaps not surrounding himself with people who can keep him informed, critics say.

Also this week, NBC reported first that the administration in 2010 that ObamaCare was written in such a way that the president's promise about Americans being able to keep their health insurance plans could not be kept.

Maine Republican Sen. Susan Collins, said the chamber's Intelligence Committee of which she is a member was not aware of the NSA doing surveillance on foreign leaders but the REAL question is whether the president knew and if he didn't she assumed he would ask for the resignation of whoever was responsible for not telling him.

That the president didn't know about the United States monitoring the phone calls of allies also seems surprising considering the program started in the Bush administration after the 9-11 terror attacks.

White House Press Secretary Jay Carney recently shrugged off a question about whether the president is out of the loop, suggesting it was just another partisan attack.

"It's certainly true that you've conflated a bunch of very disparate issues," he told a reporter. "Republican critics say a lot of things."

The Republican National Committee sees a pattern. The group has released a list of incidents -- under the titled "Bystander President" -- in which Obama appeared to caught unaware, such as the request for additional security at the U.S. consulate in Benghazi, Libya, prior to the fatal Sept, 11, 2012 terror attacks and about the Justice Department's use of subpoenas against reporters.

Presidential historian Stephen Hess, of the Brookings Institution, says sometimes it's convenient for a commander in chief to be out of the loop, but his aides had better pick those times carefully.

Hess suggests in the long run, Mr. Obama might be able to weather the storm over the NSA's aggressive spying, especially since it seems to predate his administration. But the botched ObamaCare rollout may be more problematic.

"That's a loop he had better be in because that is the legacy of his whole administration," Hess told Fox News this week. "That's a little different than whether Chancellor Merkel is upset today because somebody in the NSA was listening in on her cell phone."

Politico has called claims the president was unaware of the recent episodes his "in-the-dark defense."

"The bottom line explanation in all these instances is the same: President Obama didn't know any more about the scandal than the ordinary person on the street, and certainly wasn't involved in decision-making processes — at least, not until long after potential problems arose."

WASHINGTON –  Government safety rules are changing to let airline passengers use most electronic devices from gate-to-gate -- although you'll still have to stow your stuff during take-off and landing.

Passengers will eventually be able to read e-books, play games, and watch videos on their devices during all phases of flight, with very limited exceptions, the Federal Aviation Administration said Thursday morning.

A new FAQ on the FAA's website offers more information on the new policy in a question and answer format. 

Can I use my e-book reader throughout my flight now?

Once your airline has shown the FAA its airplanes can safely handle radio interference from portable electronics, they can let you use your devices in airplane mode only most of the time. 

Do the new rules apply to both domestic and international flights on U.S. airlines?

Yes. U.S. airlines may expand the use of electronic devices on domestic and international flights.

And everyone must put their gizmos down during the safety briefing and listen up, for heaven's sake.

For anyone who's longingly looked at that laptop during a 5-hour cross-country flight, the news will come as a delight, despite several caveats and restrictions. Electronic items, books and magazines, must be held or put in the seat-back pocket during the actual take-off and landing, for example. And cell phones should be in airplane mode or with cellular service disabled -- meaning no signal bars displayed.

Passengers still won't be allowed to use cell phones for voice communications: FCC regulations will still prohibit any airborne calls using them. But Candy Crush? Go for it.

If your air carrier provides Wi-Fi service during flight, you may use those services. You can also continue to use short-range Bluetooth accessories, like wireless keyboards, the FAA said.

"I commend the dedication and excellent work of all the experts who spent the past year working together to give us a solid report so we can now move forward with a safety-based decision on when passengers can use [portable electronic devices] on airplanes," said FAA Administrator Michael Huerta.

'We're pleased the FAA recognizes that an enjoyable passenger experience is not incompatible with safety and security.'

A4A, an aviation industry trade group, applauded the decision.

"A4A commends the Portable Electronic Devices (PED) Aviation Rulemaking Committee (ARC) for its report and recommendations on expanded use of personal electronic devices inflight. A4A and our members will work with the FAA to ensure expanded customer use of electronic devices is implemented safely and expeditiously."

Most new airliners are expected to meet the criteria, but changes won't happen immediately. Timing will depend upon the airline.

Connections to the Internet to surf, exchange emails, text or download data will still be prohibited below 10,000 feet. Heavier devices like laptops will have to be stowed.

A travel industry group welcomed the changes, calling them common-sense accommodations for a traveling public now bristling with technology. "We're pleased the FAA recognizes that an enjoyable passenger experience is not incompatible with safety and security," said Roger Dow, CEO of the U.S. Travel Association.
